Terms of Service

1. Scope

These Terms and Conditions (T&C) apply to the use of the Quisivo platform, operated by Markus Nissl Consulting GmbH, Siegesplatz 17/1/15, 1220 Vienna, Austria (hereinafter "Provider").

2. Service Description

Quisivo is a Software-as-a-Service (SaaS) platform for creating and managing digital competitions. The platform enables:

• Creation of interactive competitions and contests
• Management of participants and their data
• Automated and manual winner selection
• Email notifications to participants
• Management of prizes and rewards

3. Contract Formation and Registration

Registration is completed by creating a user account. By registering, the user accepts these T&C. The user warrants that all provided information is correct and complete.

4. Usage Rights and Obligations

The user commits to:

• Use the platform only for legally permissible competitions
• Comply with all applicable laws and regulations for competitions
• Not create misleading or fraudulent content
• Not violate third-party rights
• Keep access credentials confidential and not share them with third parties

5. Data Protection

The processing of personal data is carried out in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR). The user is solely responsible for the lawful processing of participant data they collect.

6. Hosting and Infrastructure

The platform is hosted on:

• Railway (Railway Corporation, USA) for application hosting
• Supabase (Supabase Inc., USA) for database and authentication
• Stripe (Stripe, Inc., USA) for payment processing

All providers meet GDPR requirements and offer corresponding data protection agreements.

7. Availability

The Provider strives for high platform availability but cannot guarantee uninterrupted availability. Planned maintenance work will be announced in advance whenever possible.

8. Liability

The Provider's liability is limited to intent and gross negligence. The user is solely responsible for the legality of competitions they create and compliance with respective national regulations.

9. Termination

The user may terminate their account at any time. After termination, all data will be deleted in accordance with legal retention periods.

10. Changes to T&C

The Provider reserves the right to change these T&C at any time. Changes will be communicated to the user via email. In case of objection within 14 days, the user may terminate the contractual relationship.

11. Final Provisions

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is Vienna, Austria.
